Return Policy and Limited Product Warranty

Customers outside of Europe and the USA are required to pay VAT or any duties and taxes imposed by their local government authorities.
RETURN POLICY
If you are unsatisfied with your purchase of a Matrix PowerWatch ® (each, a “Watch”) from the website at https://www.powerwatch.com/ for any reason, you have fourteen (14) calendar days from the date of Matrix’s shipping confirmation email (the “Purchase Date”) to request a refund minus a $35 restocking fee. You may return any Watch purchased on the websites listed above in accordance with the terms below.
To qualify for a refund, all the following conditions must be met:
- A return authorization must be requested from our customer service team within 14 days of your Purchase Date. To request a return authorization, please contact Matrix Customer Service at support@matrixindustries.com.
- You must return the Watch to Matrix to receive a refund. Returned Watch(es) must be in good physical condition (not physically broken or damaged). All accessories originally included with your purchase must be included with your return.
- The return authorization number must be included along with your returned product.
Additional terms and conditions:
- Shipping and handling charges and taxes paid (such as state, customs, or VAT) are not refundable.
- You are responsible for, and must prepay, all shipping charges, and you assume the risk of loss or damage to the returned Watch(es) while in transit back to Matrix.
- If you return a Watch to Matrix (a) without a return authorization from Matrix or (b) without all parts and accessories originally included with your purchase, Matrix retains the right to either refuse acceptance of such return or charge you a restocking fee of 25% of the original price of the Watch(es) or the retail value of the missing parts and accessories, whichever is higher.
Once Matrix receives the Watch(es) in good condition, Matrix will issue a refund and send you a return receipt confirmation email. Credit card refunds will be sent to the card-issuing bank within five (5) business days of receipt of the returned item. Please contact the card-issuing bank with questions about when the credit will be posted to your account.
LIMITED PRODUCT WARRANTY
THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER LEGAL RIGHTS, WHICH VARY FROM STATE TO STATE (OR BY COUNTRY OR PROVINCE). MATRIX DOES NOT EXCLUDE, LIMIT OR SUSPEND OTHER LEGAL RIGHTS YOU MAY HAVE UNDER THE LAWS OF YOUR STATE (OR COUNTRY OR PROVINCE). FOR A FULL UNDERSTANDING OF YOUR RIGHTS YOU SHOULD CONSULT THE LAWS OF YOUR STATE, COUNTRY OR PROVINCE.
Matrix warrants to the original purchaser that your Watch shall be free from defects in materials and workmanship under normal use for a period of one (1) year from the Purchase Date, except that if you reside in the European Economic Area (EEA) and you purchased your Watch in the EEA, the warranty period is two (2) years from the Purchase Date (the “Warranty Period”). In case of replacement, Matrix cannot guarantee that you will receive the same model Watch. If your model is not available, a Watch of similar style will be provided. Matrix reserves the right to discontinue or change parts, models or products, or to make substitutions.
- Remedies
If such a defect arises and a return authorization request is received by Matrix within the applicable Warranty Period, Matrix will, at its option and to the extent permitted by law, either (a) repair the Watch at no charge, using new or refurbished replacement parts or (b) replace the Watch with a new or refurbished Watch. In the event of such a defect, to the extent permitted by law, this is your sole and exclusive remedy for any breach of warranty. Shipping and handling charges may apply except where prohibited by applicable law. Any replacement Watch will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer, or for any additional period of time that may be required by applicable law.
- How to Obtain Warranty Service
To obtain warranty service, a return authorization must be requested from our customer service team. To request a return authorization, please contact Matrix Customer Service at support@matrixindustries.com. The return authorization number must be included along with your returned product. You must deliver the Watch, in either its original packaging or packaging providing an equal degree of protection, to the address specified by Matrix. As may be required by applicable law, Matrix may require you to furnish proof of purchase details and/or comply with other requirements before receiving warranty service.
If you seek warranty service outside of your original country of purchase, Matrix cannot guarantee that the parts and products needed to repaid or place your product will be available due to differences in product offerings and applicable standards, laws and regulations.
- Exclusions and Limitations
Matrix does not warrant that the operation of the Watch will be uninterrupted or error-free. This Limited Product Warranty does not cover software embedded in any Watch and related services provided by Matrix.
This Limited Product Warranty applies only to the original purchaser of the Watch that was purchased from an authorized reseller or sales channel and manufactured by or for Matrix that can be identified by the Matrix PowerWatch ® trademark affixed to it. Without limiting the foregoing, the Limited Product Warranty does not apply to any (a) Matrix products and services other than the Watch, (b) non-Matrix products, even if included or sold with a Watch, including, without limitation, any counterfeit products, (c) products that are, or Matrix reasonably believes to be, stolen, (d) Watch straps, (e) Watch LCD screens, (f) consumable parts, such as batteries, unless product damage has occurred due to a defect in materials or workmanship, or (g) software, even if packaged or sold with the Watch or embedded in the Watch.
This warranty does not apply to a Watch or part of a Watch that has been serviced, altered, refurbished, or modified by anyone who is not authorized by Matrix, nor does it apply to any cosmetic damage such as scratches and dents. In addition, this Limited Product Warranty does not apply to damage or defects caused by (a) use with non-Matrix products or technologies; (b) accident or neglect, such as physical damage (cracks or scratches, etc.) to the surface of the Watch resulting from misuse, abuse, misuse, mishandling, flood, fire, earthquake or other external causes; (c) normal wear and tear or aging of the Watch such as discoloration or stretching; (d) damage to a product that has been connected to power and/or data cables that are not supplied by Matrix; or (e) operating the Watch (i) outside the permitted or intended uses described by Matrix, or (ii) not in accordance with instructions provided by Matrix. In addition, Matrix reserves the right to refuse warranty claims against Watches that are obtained and/or used in contravention of the laws of any country.
No Matrix reseller, distributor, agent or employee is authorized to make any modification, extension, or addition to this Limited Product Warranty. If any term contained herein is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.
- Implied Warranties
EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, THE WARRANTIES CONTAINED IN THIS LIMITED PRODUCT WARRANTY ARE EXCLUSIVE AND IN LIEU OF, AND MATRIX EXPRESSLY DISCLAIMS, ALL OTHER WARRANTIES AND REMEDIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE (INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE). THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER LEGAL RIGHTS, WHICH VARY FROM STATE TO STATE AND FROM COUNTRY TO COUNTRY. IF IMPLIED WARRANTIES CANNOT BE DISCLAIMED UNDER THE LAWS OF YOUR STATE OR COUNTRY, THEN SUCH WARRANTIES ARE LIMITED IN DURATION TO THE DURATION OF THIS LIMITED WARRANTY. SOME STATES (AND COUNTRIES AND PROVINCES) DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
- Limitation of Damages
EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, MATRIX SHALL NOT BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, REVENUE OR DATA, RESULTING FROM ANY BREACH OF EXPRESS OR IMPLIED WARRANTY OR CONDITION OR UNDER ANY OTHER LEGAL THEORY, EVEN IF MATRIX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some jurisdictions do not allow the exclusion or limitation of special, indirect, incidental or consequential damages, so the above limitation or exclusion may not apply to you.
- Governing Law
This Limited Product Warranty shall be governed by and interpreted in accordance with the laws of the State of California, excluding: (a) that body of law known as conflicts of law, and (b) the United Nations Convention on Contracts for the International Sale of Goods.
- National Statutory Rights
Consumers in some jurisdictions may have legal rights under applicable national legislation governing the sale of consumer goods, including, without limitation, national laws implementing EC Directive 99/44. These rights are not affected by the warranties in this Limited Product Warranty.
For Australian consumers: Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
